Terms of Service

These Terms of Service ("Terms") govern your use of the Mycel macOS and iOS applications and the mycel.live website (collectively, the "Service"), provided by Fossier Studio LLC, a Louisiana limited liability company ("Fossier Studio", "we", "us"). By downloading, installing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Mycel is a developer tool that monitors GitHub Actions activity using a GitHub sign-in or personal access token that you supply. The apps run locally on your device and communicate directly with GitHub's API. To deliver push notifications and Live Activities, we also operate a relay that receives workflow events from the Mycel GitHub App and forwards them to Apple or Google push services, as described in our Privacy Policy.
2. Your account and credentials
- You are responsible for the GitHub account and access token you provide to the Service, and for keeping that token secure.
- You must have the right to monitor any repository you add to Mycel.
- You agree to comply with GitHub's terms and rate limits when using the Service.
3. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except where applicable law expressly permits it.
- Use the Service to violate any law or any third party's rights.
- Use the Service to abuse GitHub's API or circumvent its rate limits.
- Resell, sublicense, or redistribute the Service without our written permission.
4. Trial and paid plans
Mycel offers a free trial period and may offer paid subscriptions and/or a one-time lifetime purchase via the Apple App Store (paid plans are not currently sold on other platforms). Pricing, billing, renewal, and refunds for any paid plan are handled by Apple under Apple's standard terms. We do not process payments directly and do not receive your payment details. Trial and pricing terms displayed on mycel.live or in the app at the time of purchase apply to that purchase.
5. Updates and changes to the Service
We may update, change, or discontinue the Service (or any feature of it) at any time. We will use reasonable efforts to give notice of material changes that affect existing paid users.
6. Intellectual property
The Service, including the Mycel name, the mushroom mark, the app binaries, and the mycel.live website, is owned by Fossier Studio LLC and is protected by intellectual property laws. These Terms grant you a limited, personal, non-transferable, non-exclusive license to use the Service for its intended purpose. No other rights are granted.
7. Third-party services
The Service interoperates with GitHub, delivers notifications through Apple and Google push services, and is distributed through the app stores of Apple, Google and Microsoft. Your use of those third-party services is governed by their respective terms and privacy policies. We are not responsible for the availability or behaviour of any third-party service.
8. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that the Service will be error-free, that notifications will always be delivered, or that the Service will catch every CI event.
9. Limitation of liability
To the maximum extent permitted by law, Fossier Studio LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total cumulative liability for any claim related to the Service will not exceed the greater of the amount you have paid us for the Service in the twelve months preceding the claim, or fifty US dollars (US$50).
10. Indemnification
You agree to indemnify and hold harmless Fossier Studio LLC from any claim or demand, including reasonable attorneys' fees, arising out of your misuse of the Service or your violation of these Terms.
11. Termination
You may stop using the Service at any time by uninstalling the apps. We may suspend or terminate your access to the Service if you violate these Terms. Provisions that by their nature should survive termination (including sections 6–10 and 12–13) will survive.
12. Governing law and venue
These Terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or related to these Terms or the Service will be the state and federal courts located in Louisiana, and you consent to the personal jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the date above and post the revised Terms at this URL. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
